Oracle Keynote at Cloud Expo New York
Oracle – which may or may not have broken the European Commission’s lock on its Sun acquisition – is now being sued for fraud and copyright infringement in California by a Georgia outfit called MB Technologies that claims Oracle is illegally using its Bindows technology for its Fusion Applications user interfaces.
As the name suggests, the toolkit gives a UI the look and feel of a Windows app.
Oracle reportedly inherited a 2004 licensing agreement with MB Technologies when it acquired Hyperion in 2007 but told MB Technologies it only meant to use its technology for existing Hyperion products and then only for a short period of time.
The Georgia company claims Oracle told it that it mean to replace the Bindows widgetry inducing it to give Oracle rights at a better price. Oracle then allegedly retracted a draft addendum it wrote and never discussed with MB Technologies covering Fusion.
MB Technologies reportedly thought the deal was dead.
Then it recently got e-mail confirmation from Oracle executive Robert Gersten that Oracle was using Bindows for three EPM Fusion add-ons and didn’t want to rewrite the GUIs. MB Technologies says it couldn’t come to terms on price after that.
The next-generation Fusion Apps are supposed to be released this year.
